Il plenum del Consiglio superiore della magistratura ha bocciato, con 19 voti favorevoli, 3 contrari e un astenuto, la responsabilità civile diretta dei magistrati, ipotesi introdotta nella legge Comunitaria approvata alla Camera e attualmente all’esame del Senato.
La motivazione: «Potrebbe preferire la soluzione che lo possa meglio preservare dal rischio dell’esercizio dell’azione diretta»
Ora capisco perché dal 1988 ad oggi 400 cause di responsabilità avviate solo 34 ammissibili e appena 4 condanne.
