La Corte di cassazione, è bene ricordarlo, interviene su singoli casi, i suoi pronunciamenti fanno giurisprudenza ma non sono leggi universali. Per questo i giudici dovrebbero astenersi da considerazioni che esulano dal loro ruolo. Non è stato loro delegato il compito di legiferare né quello di sancire che cosa sia una famiglia e l’educazione di un figlio.
Per questo è molto grave dire, come ha fatto la prima sezione civile della Suprema corte, che un padre che ricorre contro l’affidamento del figlio alla madre convivente con un’altra donna è vittima del “mero pregiudizio che sia dannoso per l’equilibrato sviluppo del bambino il fatto di vivere in una famiglia incentrata su una coppia omosessuale”.

La storia della civiltà, l’esperienza di miliardi di coppie e di figli, il tessuto basilare del nostro vivere sociale, cioè la famiglia fondata sul matrimonio di un uomo e una donna, non possono essere ridotti a un “mero pregiudizio”. Sono la base invece del giudizio, fondato e ragionevole, che i bambini è meglio che abbiano un padre e una madre.
Non entro nel merito della decisione sul caso singolo, ma le parole usate per la sua motivazione sembrano un ulteriore tentativo di perseguire per via giudiziaria l’attacco alla famiglia già respinto dai cittadini italiani in altre occasioni.

In riferimento alla sentenza della Prima sezione civile della Cassazione che ha stabilito la legittimità dell’affidamento esclusivo di un bambino alla mamma che vive con un’altra donna,io non condivido la motivazione dei giudici della Cassazione.La natura ha già stabilito l’armonia tra maschio e femmina ,questo si nota anche nel mondo animale,delle piante e naturalmente nel genere umano.Intendo ricordare a chi emana tali sentenze e ai politici che nella famiglia avvengono processi di identificazione,di formazione del Super- Io, dell’ideale dell’Io e come dice Freud la risoluzione normale del “complesso di Edipo”.Occorre stare molto attenti oggi per evitare un domani pieno di persone poco equilibrate alla ricerca di uno psicoanalista.

Vuol forse negare che la “natura” esclude l’omosessualità e l’ermafroditismo, ad esempio? Chi è omosessuale per natura, e non per moda o per altri motivi, lo è davvero e in un bel po’ di specie animali 🙂 Se vuole motivare la sua risposta, dunque, trovi delle fonti attendibili! Non esistono, ad oggi, prove che un bambino cresciuto in una coppia omosessuale sia destinato a diventarlo. Se lei conosce qualche studio serio in merito, ce lo faccia sapere, saremo ben lieti di darle ragione. Come anche tutti i politici che amano la “famiglia”, s’intende.

che le piaccia o no, la prova tocca a lei. Da che mondo e mondo, la generazione, sia fisica che psicologica, è affidata all’unione di un uomo e una donna. Lei se la sente di affermare, senza prove, che una cosa vale l’altra? Se la sente di correre questo rischio sulla pelle di un bambino? Per falsificare modelli pregressi ci vogliono prove. Ce le esibisca, se ne ha.
Caro Marco, di prove non ce ne sono in nessuno dei due campi. Io non sto negando la naturalità della famiglia uomo-donna; sto solo dicendo che non sono d’accordo con voi che negate quella omosessuale; non c’è nessuna presunta “superiorità naturale” di un modello sull’altro. Ovviamente è vero che uomo e donna servono entrambi per fare un figlio senza aiuti artificiali, ma – il paragone è forse audace ma non fuori dal mondo – lei negherebbe un bambino adottato a una coppia sterile, dato che la “natura” ha deciso che quelle persone non possono avere figli? Ripeto, il caso è diverso da una coppia omosessuale ma il principio è lo stesso, FINCHE’ non esistono prove che due genitori omosex cresceranno PER FORZA un figlio omosex.
La prova provata è che non c’è mai stato nessun serial killer, allevato ed educato da una coppia gay.
