Un forte stimolo al settore della nautica
Ancora provvedimenti importanti per la nautica: il Consiglio dei Ministri approva la legge delega per la riforma del codice nautico.
Abbiamo voluto imprimere un ulteriore stimolo al settore della nautica, dopo che il Decreto del Fare aveva già fissato importanti misure per il rilancio del diporto nautico. E’ significativo che ciò arrivi prima di un importante appuntamento, quello dei primi di ottobre, con il Salone nautico di Genova.

Dopo otto anni c’è l’esigenza di rivisitare un settore che sta fronteggiando i pesanti effetti della recessione che ha colpito anche la filiera dell’industria e del turismo nautico, soprattutto in conseguenza di una significativa flessione dei consumi da parte dell’utenza con barche medio-piccole.
Nel decreto del “Fare” è stata modificata la tassa di possesso con l’esenzione per i natanti fino a 14 metri, il dimezzamento per quelli da 14 a 20 metri e l’ampliamento delle fattispecie per i benefici fiscali del noleggio occasionale. Ora, la delega per la revisione del Codice della Nautica oggi approvata dal Consiglio dei Ministri, ha l’intento di dare ulteriore stimolo alla ripresa del settore produttivo, alla semplificazione, all’efficacia e alla tutela della sicurezza della nautica e dei fruitori del mare.
I punti salienti sono:
- Semplificazione degli adempimenti formali per le pratiche amministrative riguardanti l’iscrizione delle unità e l’eliminazione degli adempimenti burocratici non necessari in alcuni dei procedimenti amministrativi avviati dalle autorità marittime e dalle motorizzazioni civili
- Semplificazione del regime amministrativo delle unità diporto, utilizzate anche ai fini commerciali, con l’introduzione di normative di sicurezza specifiche di settore
- Revisione della disciplina in materia di navigazione temporanea e di prova, oggi limitata ad alcune fattispecie, che non consente ai costruttori di compiere alcune attività prodromiche alla messa in esercizio del mezzo nautico ed indispensabili ai fini dell’allestimento dello stesso
- Semplificazione della procedura amministrativa per la dismissione di bandiera anche attraverso l’introduzione di autocertificazioni che velocizzano le procedure per il rilascio dei prescritti nulla-osta da parte delle autorità marittime
- Estensione dei principi recentemente introdotti in materia di noleggio occasionale anche alla locazione allo scopo di far emergere transazioni commerciali oggi svolte in totale evasione di imposta. Sempre in tema di locazione, si vuole poi uniformare la disciplina nazionale oggi demandata alla gestione a livello periferico alle singole autorità marittime
- Introduzione di una figura specifica di mediatore che operi esclusivamente e con le peculiarità proprie del settore del diporto;
- Revisione dei titoli professionali del diporto e introduzione di un titolo semplificato per lo svolgimento dei servizi di coperta per le imbarcazioni da diporto per rendere più agevole l’accesso al lavoro anche in linea con le norme dei Paesi europei al fine di annullare l’attuale gap concorrenziale;
- Avvio ed implementazione delle attività didattiche con l’inserimento nei piani formativi scolastici della cultura del mare e dell’educazione marinara al fine di potenziare le basi per un Paese che, considerati gli 8000 Km di costa, non può che essere a vocazione marittima
- Individuazione della figura degli istruttori di vela, nel rispetto dei principi generali della sicurezza nautica in conformità con il dettato costituzionale;
- Razionalizzazione delle attività di controllo delle attività compiute dalle forze di polizia al fine di evitare sovrapposizioni di verifiche con lo scopo di ottenere economie di spesa ed armonizzare le attività di verifica in linea con il percorso già tracciato nella stagione estiva appena trascorsa con l’introduzione del “bollino blu”;
- Semplificazione dei procedimenti per l’applicazione ed il pagamento delle sanzioni amministrative pecuniarie prevedendone la graduazione in funzione della gravità delle fattispecie, della frequenza e dell’effettiva pericolosità del comportamento, oltre all’introduzione di misure riduttive dell’entità delle sanzioni, nel caso di assolvimento in margini di tempo ristretti, come recentemente previsto per le violazioni al codice della strada.

a proposito di nautica: faccio una proposta per la Costa Concordia. Visto i litigi fra le diverse Regioni per accaparrarsi il fatturato della demolizione (i soliti parassitismi, pessimo spettacolo!), perchè non mandarla nel porto militare di La Spezia (è quanto basta vicino e Livorno è troppo piccolo), anche in considerazione delle pendenze giudiziarie che ci sono sul relitto? Più sicuro da possibili appetiti e condizionamenti che in un porto militare non mi viene in mente niente!
Maurizio, perchè non lo proponi ai tuoi colleghi Ministri?

Ministro, perchè nn proporre una patente semplifica a basso costo, magari entro le 3 miglia, facilmente accessibile a chi vuole avvicinarsi alla nautica. Consideri che ora ottenere la patente entro le 12 miglia, comporta un sacco di difficolta e un programma vastissimo, e secondo me per alcune parti inutile per chi, per esempio ama la moto d’acqua, o il gommone. Questo penso che consenta di avvicinare molti giovani alla nautica,procorando di conseguenza un’incremento dei consumi.

Onorevole Lupi,
leggo del suo entusiasmo per la Legge Delega sulla Nautica, arrivata in periodo pre-Salone di Genova, ma, per la parte relativa al “Noleggi Occasionali”, essa continua nell’azione indiretta di distruzione/soppressione delle imprese commerciali di noleggio in regola con le leggi e norme italiane.
Tale azione definita ed implementata dal governo Monti e’ stata incrementata dal suo governo con le modifiche gia’ introdotte.
Due pesi e due misure dove:
– Da un lato della bilancia ci sono piume, carezze e possibilita’ di ridurre i costi per chi, principalmente per proprio svago o per attivita’ non dichiarate come commerciali, decide di possedere un imbarcazione
– Dall’altro lato della bilancia ci sono macigni, costi, burocrazia spesso incredibili per chi ha una vera impresa commerciale di noleggio con grave danno in termini di occupazione ed economico che spesso portano al fallimento o ad espatriare.
Di fatto le norme che dovrebbero far emergere potenziali attivita’ in nero sono concepite in modo da distruggere quelle realmente commerciali note e regolari.
Se il governo vuole mantenere i “Noleggi Occasionali” che almeno legiferi per scongiurare che le poche attivita’ commerciali di noleggio sopravvissute debbano dichiarare fallimento a breve.
Si informi a fondo sulla materia ma forse e’ meglio che non usi i suoi informatori abituali. Si rivolga a chi la conosce bene o a chi ha gia’ sperimentato sulla propria pelle gli effetti nefasti delle normative in materia introdotte a partire dall’autunno 2011 e fino ad oggi.
